Is AI arbitration enforceable?
A People’s Court Award is an arbitral award under a written agreement. The Federal Arbitration Act directs a court to enforce that agreement according to its terms, including the tribunal the parties selected, and to confirm the Award except on the Act’s narrow grounds. This page does not rely on a Supreme Court holding about an AI tribunal. Consent to the procedure, and a human appeal unless both parties waive it, are part of the case the parties accept.

What the Act is being asked to do
Section 2 of the Act makes a written arbitration agreement enforceable, subject to the defenses that apply to any contract. Sections 4 and 5 direct courts to follow the procedure in the agreement, including the parties’ method of appointing the arbitrator. The essay The FAA is not a human-arbitrator protection act is our reading of those provisions: if competent parties expressly select an AI tribunal, a court should enforce the procedure they selected. That essay is analysis. It is not a citation of a case that decided an AI tribunal.
The enforceability page states the confirmation timeline, the narrow vacatur grounds, the Delaware seat, and when an authorized escrow can carry out an Award without a separate court case. This page does not restate those holdings or add new ones.
Consent and the appeal
- The case proceeds only after the required consent is established, and only within its scope (Rule 3.3).
- Every party accepts the exact case-opening terms, including the procedure and who decides, before the case proceeds (Rule 2.1).
- The Award is written, resolves each claim, states the seat and the Rules version, and is signed by the Tribunal (Rule 6.5).
- Every track keeps one human appeal on the existing Record unless every party expressly waives it (Rule 9.1). The appealing party pays 15.67% of the amount in dispute, with a $520.00 minimum.
The clause that records the agreement in advance is the model clause. Contract-specific copies are linked below. A clause is still only as good as its acceptance.
Common questions
Is an AI arbitration Award enforceable?
A People’s Court Award is an arbitral award under a written agreement. A court confirms it under the Federal Arbitration Act unless it is vacated, modified, or corrected on the Act’s narrow grounds. This page does not rely on a Supreme Court holding about an AI tribunal.
Does the Federal Arbitration Act require a human arbitrator?
The Act directs courts to enforce arbitration agreements according to their terms, including the parties’ agreed method of appointing the arbitrator. Our essay reads that command as covering an expressly selected AI tribunal. That is our analysis of the statute, not a quotation of a holding about AI.
What consent does a People’s Court case require?
The case proceeds only after the required consent to arbitrate is established, and only within its scope. Every party accepts the exact case-opening terms, including the procedure and who decides, before the case proceeds.
Is there an appeal?
Yes. Every track keeps one human appeal on the existing Record unless every party expressly waives it. The appealing party pays 15.67% of the amount in dispute, with a $520.00 minimum.
Where is the longer explanation?
The enforceability page states the confirmation timeline, the vacatur grounds, the Delaware seat, and escrow execution. The essay states why we read the Act as enforcing an expressly selected AI tribunal.
